License to Use

3. Donations
All donations made through our website are voluntary contributions to Gleiche Foundation, a registered nonprofit organization.
Tax Deductibility
Donations to Gleiche Foundation are tax-deductible to the extent permitted by law.
Refund Policy
Due to the nature of charitable donations, all contributions are generally non-refundable. However, if you believe an error has been made, please contact us within 30 days of your donation, and we will review your request on a case-by-case basis.
Use of Funds
While we make every effort to honor donor designations, Gleiche Foundation retains discretion and control over all donated funds. If a specific program or project for which you donated cannot be completed or is fully funded, we reserve the right to redirect your donation to a similar program or area of greatest need.
4. Intellectual Property Rights
Unless otherwise indicated, the Services and all content, features, and functionality (including but not limited to text, graphics, images, logos, and software) are owned by Gleiche Foundation and are protected by copyright.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from our Services without prior written consent from Gleiche Foundation.
The Gleiche Foundation name and logo are trademarks of Gleiche Foundation. You may not use these marks without our prior written permission.
5. User-Generated Content
The Services may allow you to post, submit, or otherwise make available content such as comments, testimonials, or feedback ("User Content"). By providing User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, publish, and display such content.
You represent and warrant that: (a) you own or have the necessary rights to provide the User Content; (b) your User Content does not violate any third-party rights; and (c) your User Content complies with these Terms.
We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate for any reason, at our sole discretion.
6. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or usefulness of any information on the Services.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL GLEICHE FOUNDATION, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR SIXTY THOUSAND FCFA (60,000 FCFA), WHICHEVER IS GREATER.
8. Indemnification
You agree to indemnify, defend, and hold harmless Gleiche Foundation and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your access to or use of the Services; (b) your User Content; or (c) your violation of these Terms.
9. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
You waive any right to participate in a class action lawsuit or class-wide arbitration.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.
11. Severability and Waiver
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
